GETPELVIQ.COM is owned and operated by SPACELAB MARKETING LLC, a limited liability company headquartered at 5830 East 2nd Street, Ste. 8, Casper, WY 82609 (hereafter referred to as "GETPELVIQ").
The website is hosted by Shopify, located at 150 Elgin Street, 8th Floor, Ottawa, Ontario, K2P 1L4, CANADA.
Article 1: Definitions
For the sake of clarity in these Terms of Use, the following terms will have the meanings ascribed to them in this article:

| Website | Refers to the website https://getpelviq.com, where you can view, purchase, and have consumer goods delivered. |
| User | Any adult or legal entity registered on the website who subscribes to the service, if applicable. |
| Visitor | Any natural or legal person accessing the website for consultation without a user account. |
Article 2: Acceptance of the Terms of Use
These T&Cs govern the use of the website and the access of users to the services offered. Acceptance of these Terms of Use is a condition for accessing and using the services described herein.
Any registration and/or subscription to free or paid services implies the unconditional acceptance of the T&Cs by the user, who has read, understood, and agreed to them.
Acceptance is confirmed through a checkbox during registration ("I accept the Terms of Use"), and a link to view the T&Cs is also provided in the account activation email.
The current version of the T&Cs is available at all times on the website. GETPELVIQ reserves the right to modify the T&Cs at any time due to technical, economic, legal, or commercial reasons, such as the introduction of new services.
Users will be notified of any changes to the T&Cs within a reasonable time frame. When logging in, they may be required to accept the new terms to continue using the services.
If the user does not agree, they may cancel their subscription, effective once the user's last order, if placed before the T&Cs change, has been delivered.
Any deviation from these T&Cs must be formalized in writing and signed by both GETPELVIQ and the user. GETPELVIQ reserves the right to suspend or immediately terminate services for any user who violates the T&Cs. A printed copy of the T&Cs and any electronically transmitted information may be included in legal proceedings related to these T&Cs, similar to a paper document.
Failure by GETPELVIQ to enforce any of these conditions at any time shall not be construed as a waiver of the right to enforce them at a later time.
Article 3: Access to the Website
The website is available to any user with internet access, free of charge. Users are responsible for all costs associated with accessing the service (e.g., hardware, software, internet connection). Users who are not members do not have access to certain services; registration is required by filling out the form provided.
Article 4: Website Registration
Access to the website and registration as a user are free. Creating an account is done in accordance with the instructions on GETPELVIQ.COM, particularly by completing the electronic form. Only adults over the age of 18 not under guardianship may register. Certain data is required to create the account and enable the service. The accuracy of the user's information is assumed, and they are responsible for keeping it truthful.
Article 5: Account Suspension or Deletion
The user may request the deactivation of their account at any time via email or directly online. GETPELVIQ will deactivate the user's account within seven (7) days of receiving the request, provided there are no pending orders. GETPELVIQ will delete the user's data per our data processing policies. If the user violates these T&Cs, GETPELVIQ reserves the right to temporarily suspend or delete the account at its discretion.
Article 6: User Obligations
By using GETPELVIQ.COM, the user agrees NOT to:
- Transmit illegal, abusive, defamatory, or harmful content.
- Impersonate another user.
- Reproduce, modify, or distribute the website or its content without authorization.
- Use software or processes to copy content without prior written permission from GETPELVIQ.
Article 7: Intellectual Property
The entire website is protected by U.S. and international intellectual property laws. All rights are reserved, including for downloadable documents. The texts, graphics, logos, and all elements of the site are protected. Unauthorized use or reproduction of any content will lead to legal action by GETPELVIQ.
Article 8: Disclaimer of Warranties
The website is provided "as is" and "as available," without any warranties. The user is aware of the limitations and risks of internet usage and is responsible for protecting their equipment against viruses and malware. GETPELVIQ shall not be liable for data loss, connection issues, or any damages arising from the use or inability to use the website.
Article 9: Force Majeure
GETPELVIQ shall not be liable in the event of force majeure, such as events outside its control, including transportation disruptions, regulatory changes, strikes, accidents, or other situations preventing the proper operation of the website.
Article 10: Cookies
During your visit, a cookie may be installed on your browser. Cookies are temporary files necessary for using GETPELVIQ.COM and contain no personal data. By using the website, the user consents to the use of cookies, which can be disabled via browser settings.
Article 11: Proof Agreement
The user's actions on the website, including acceptance of terms and other elements through appropriate checkboxes, are equivalent to a handwritten signature and form an electronic contract.
Article 12: Severability
If any provision of these T&Cs is found invalid by law or court decision, the remaining provisions will continue to be valid and enforceable. GETPELVIQ will promptly remove and replace the invalid clause with a valid one.
Article 13: Governing Law
These T&Cs are governed by U.S. law. Any claims must be submitted to support@getpelviq.com within fourteen (14) days of the execution or intended execution of the service.
If the parties cannot resolve a dispute, the courts of the United States shall have jurisdiction.
